Moleskine Foundation ETS (“Moleskine Foundation”, or “we”, “us”, “our”) commits to protecting and respecting your privacy and to providing you with all required information in relation to the processing of personal information that we collect about you or that you provide to us, in compliance with the applicable data protection law, both European and Italian.
First of all, to make this disclosure clearer, definitions of the key words contained in the Privacy Policy are provided below.
– Personal data: any information relating to a natural person who is identified or identifiable, including indirectly, by making reference to any other information, including a personal identification number or an online identifier;
– Processing: any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means (e.g. the collection, registration, storage, consultation, processing, modification, use and disclosure of information);
– Data controller: natural person or legal entity, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data (in this case, the Moleskine Foundation);
-Data processor: natural person, legal entity, public authority, agency or other body appointed by the data controller to process personal data on behalf and in the interests of the data controller;
-Person in charge of data processing: natural persons authorised to carry out processing operations by the data controller or the data processing processor;
-Data subject: the party to whom the personal information refers.

For the purposes of this Privacy Policy, the data controller is Moleskine Foundation ETS.

Moleskine Foundation appointed several data processors, choosing among professionals providing suitable guarantees to implement appropriate technical and organisational measures in such a manner that processing will be always conducted in compliance with the applicable laws and ensuring the protection of your rights. In particular, we use as data processor for the website backend management the web agency Accept&Proceed
Upon request, we will provide a complete and updated list of all data processors concerned with the processing of your data.

Your information subject to collection and processing

For the purposes of this Privacy Policy, all anonymous information not suitable in and of itself to enable personal identification is not considered personal information. The Moleskine Foundation website does not record any type of information that allows for your personal identification and does not process data for profiling nor advertising purposes.

We collect and process the following personal information about you:

1. Information that you provide to us directly

You could provide us with data about yourself that you choose to share with us in one or more of the following circumstances:

a) By becoming a member of the Moleskine Foundation ETS.
Data processed: To become a member of the Moleskine Foundation, you are requested to file a form, inserting your name, surname, email address, code of your coupon, if available, and bank details.
Purposes and Legal basis: Your data provided in the context of the registration will be processed for the sole purpose of making you a member of the Moleskine Foundation and receiving the bank transfer made by you to pay and renew the annual membership fee. The legal basis we use to process your data for this purposes is the necessity for the performance of the membership contract you would become part of as a consequence of your application.
Retention period: Your data will be retained by us for as long as you remain a member of Moleskine Foundation and for a period of 6 months thereafter. At the end of the retention periods, your data will be deleted.
* By filing the form to become member of the Moleskine Foundation, you also will be asked whether you want to receive the newsletter. With regard to the processing of your data for such purpose, see paragraph e) below.

b) By downloading our press folder.
Data processed: If you want to download our press folder in order to get information and be provided with images concerning our projects and main events, you are requested to file a form, inserting your name, surname and email address.
Purposes and Legal basis: Your data provided in the context of the registration will be processed for the sole purpose of providing you the press folder. To this end, when filling out the fields, you will be asked to provide your consent to the processing of your information for such purposes.
Retention period: Your data will be stored for 2 months.
* By downloading our press folder, you also will be asked whether you want to receive the newsletter. With regard to the processing of your data for such purpose, see paragraph e) below.

c) By asking us for some information or, more in general, by contacting us by telephone, email or other means which express your wish to communicate with us.
Data processed: We will collect and process every information that you decide to share with us (e.g. email address, name…).
Purposes and Legal basis: When you communicate with us by telephone, email or in another manner, your consent will be deemed provided simply due to the fact that you have contacted us. Your data will processed for the sole purposes concerning your requests.
Retention period: Your data will be stored for the time strictly necessary for us to respond to your requests, and in any case no longer than 6 months.

d) By sending us an application to voluntarily work with Moleskine Foundation.
Data processed: We will collect and process every information that you decide to share with us (e.g. email address, name, work experiences, telephone number…).
Purposes and Legal basis: When you communicate with us by email your consent will be deemed provided simply due to the fact that you have contacted us. Your data will processed for the purposes concerning your application to work with us.
Retention period: Your data will be stored for the time strictly necessary for us to assess your application and possibly to contact you. The information provided by you with your application will be kept for no longer than 2 years.

e) By signing up for receiving our newsletter.
Data processed: If you want to receive our newsletter and be updated on our projects and events, you are requested to file a form, inserting your name, surname, and email address.
Purposes and Legal basis: Your data provided in the form will be processed with the sole scope of sending you our newsletter. To this end, when filling out the fields, you will be asked to provide your consent to the processing of your information for such purposes.
Retention period: Your data will be stored for 1 year.

f) By making a donation to support one of the Moleskine Foundation’s projects.
Data processed: If you want to support the Moleskine Foundation, you are requested to file a form, inserting your name, surname, email address, invoicing address, city and postal code, country, amount that you decide to donate, and bank details including your card details.
Purposes and Legal basis: Your data provided in the context of the registration will be processed for the sole purpose of receiving the donation. The legal basis we use to process your data for this purpose is the performance of the donation.
Retention period: Your data will be stored for one year, except for your bank details, that will be stored upon issuance by the bank of the wire receipt of the accomplished transfer. At the end of the retention periods, your data will be deleted.
* By filing the form to make a donation, you also will be asked whether you want to receive the newsletter. With regard to the processing of your data for such purpose, see paragraph e) above.

g) By purchasing our magazine Folios.

Data processed: To purchase our magazine Folios, you are requested to file a form*, inserting your name, surname, street address, email address, fiscal code/VAT number, phone number and bank details.

Purposes and Legal basis: Your data provided in the context of the purchasing will be processed for the sole purpose of enabling you to buy the magazine and receive the bank transfer made by you to pay for it. The legal basis we use to process your data for this purposes is the need to perform the purchase contract you would become a party to as a consequence of your application.

Retention period: Your data will be retained by us for a maximum of ten (10) years from the end of the business relationship between you and Moleskine Foundation or, if longer, until any potential legal dispute with you is resolved, in order to comply with legal and/or accounting obligations. At the end of the retention period, your data will be deleted, unless it is necessary to retain this data for a longer term in order to comply with a legal obligation or to protect Moleskine Foundation rights before a competent authority.

Information that we collect about you

Data processed: Every time you visit our website, navigation information will be gathered automatically:
– technical information, including IP addresses or domain names used to connect to our website, the type and version of the browser you are using, the time/zone settings, the type and version of browser plug-ins, the operating system and the platform you are using;
– information on your visit to our website and online navigation records, including the entire URL, data on the series of clicks generated (clickstream), navigation dates and time; the resources requested and the size of the file obtained in response, the time and the status of the reply given by the server (successful, error, etc.), the methods used to exit webpage navigation.
Purposes and Legal basis: Navigation information is not collected with the primary aim of identifying users, however due to its very nature it may allow for the identification of users by means of processing and correlation with data held by third parties.
Personal information will be processed for the following purposes:
-to ensure that our website content is presented in the most effective manner for you and your devices, by continuously improving the navigation experience, design and layout of the website, as well as web analytics tools;
-to administer our website and for internal operations, including checking the proper functioning of the website and resolving problems;
-to obtain anonymous statistical information on the use of the website, data analyses, research and statistical purposes and for surveys;
-to enable you to use some of our service’s interactive functions (such as those with social networks), should you choose to do so;
-to guarantee our website’s security;
-to ascertain liability in the case of any cybercrimes to the detriment of the website.
Retention period: period strictly necessary to allow the above procedures.

Provision of information and refusal of processing

You are always free to decide whether to provide your personal information.
However, any refusal to provide the information necessary for navigation purposes may make activities closely connected and instrumental to navigation impossible.
The provision of information to register for the Newsletter is completely optional and in no manner interferes with activities linked to navigation on the website. In addition, consent to processing may always be withdrawn by unsubscribing from the newsletter.

The provision of your information through the purchasing form of Folios magazine is necessary to proceed with your purchase and, in case of failure, we will not be able to proceed with it.

Data processing and storage methods

The processing will be carried out in automated and manual form, with methods and tools meant to guarantee the utmost security and privacy, by parties made responsible for this in compliance with the provisions of the applicable laws.

Save for the retention periods specified above, unless cybercrimes are committed to the detriment of the website, the information will be stored for the period of time strictly necessary for the purposes for which the information was gathered and subsequently processed and on the basis of the applicable privacy laws and regulations.

Sharing your data

We do not take information about you from public entities or private organisations.
We may share anonymous information with third parties to provide additional information for analysis and statistics on the use of the website for research purposes.
We may transfer your data to service providers in order to ensure the correct performance of the website or to allow you to interact with us. Such service providers will process your data according to our instructions and for the sole purposes you provide us your data for.

Rights of the data subjects

In particular you have the right to obtain, at any time, confirmation of the existence or otherwise of the information and to be informed of its content and source, to verify its accuracy and to ask for it to be supplemented, updated or adjusted, as well as be informed of the purpose and methods of the relative processing and the identity of the parties to which your data may be disclosed, the data processor and the data processors.
You have the right to have the information deleted, transformed into anonymous form or blocked if processed in breach of the law, as well as object to its processing. You have always the right to revoke your consent to the processing. In this event, the processing of data based on your consent is deemed as legitimated until the revocation.
You are also entitled to obtain a certification documenting the operations noted above and to object to the processing of your personal information, whether this takes place for the declared purposes for which it was collected, or for the purpose of sending advertising material or commercial messages.
Where the processing of your data is based on your consent, you have also the right to data portability, i.e. the right to receive your personal data we process upon your consent, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from Moleskine Foundation. In exercising your right to data portability, you have the right to have the personal data transmitted directly from one controller to another, where technically feasible.

If you decide to contact the data controller or data processor for these purposes, please provide your email address, name, address and/or telephone numbers in order to allow for the proper management of the request.

As an alternative to the automatic unsubscribing systems specified above (unsubscribing from the Newsletter), to no longer receive communications via automated direct means (email, social networks), simply send an email to the address info@moleskinefoundation.org at any time, with the subject “cancellazione da automatizzato” (“unsubscribe from automated communications”).

Amendments to the privacy disclosure

We reserve the right to update and/or modify this Privacy Policy at any time.
As the party concerned by the data processing, you are required to periodically check for any changes. In order to facilitate this verification, the most recent date of updating will be specified on the Privacy Policy. Please take note that navigation on our website after the publication of changes will constitute acceptance of them.

Social plug-ins and relations with social networks or third parties

Our web pages allow for interaction with social networks by means of sharing buttons and also may contain social network plug-ins (e.g., Facebook, Twitter, YouTube).
If you access one of our web pages equipped with this type of plug-in, the web browser connects directly to the servers of the social network and the plug-in is displayed on the screen thanks to the connection with the browser. If a party concerned who uses a social network visits our web pages while connected to a social account, his or her personal information may be associated with the social account. The information will also be associated with the social account if the plug-in functions are used.
As regards the methods of privacy protection and the processing of the personal information collected by those social networks to allow for the above-mentioned interaction, please refer to the pages of the individual social networks. If the user of our website does not want to associate the visit to our web pages with a social account, he or she must log off from the social network before visiting them.
Please take note that if a service for interaction with social networks is installed, it is possible that, even if you are not using the service, they may collect traffic data relating to the pages on which it is installed.

Please note that for the purposes of donating as above described under letter f), our website uses a third-party online payment service provider, which acts as autonomous data controller with respect to your payments data. We will not process or know anyhow such payments data.

Privacy Policy

This Privacy Policy should not be considered valid for any other third-party websites that may be consulted via the links present on the Moleskine Foundation website.
